Avinat Desk: terms of use

1. Who we are

Avinat Desk (“the Desk”) is operated by Avinat LLP, a limited liability partnership registered in England and Wales (number OC417925), whose office is at 7 Bevendon Square, Salford, M7 4TF. Contact: info@avinat.com.

2. What the Desk is

The Desk is Avinat’s internal web application. Avinat staff use it to carry out bookkeeping, payroll, VAT and related compliance work for Avinat’s clients, including sending information to and receiving it from HM Revenue & Customs (HMRC). The Desk is not a product offered to the public and clients do not log in to it.

3. Who may use it

• Only Avinat partners and staff who need it for their work, each with their own login. Logins and passwords must not be shared.
• Users must follow Avinat’s information security policy.

4. Client data

• Avinat processes client data through the Desk on the client’s behalf, under the terms of its engagement with that client and as described in the Avinat privacy notice at avinat.co.uk/privacy.
• Client data is encrypted when it is sent over the internet, and access tokens and secrets are encrypted when stored.
• The Desk is hosted in the United Kingdom.
• Clients can ask Avinat to give them a copy of their data, correct it or delete it, as set out in the privacy notice. Requests go to info@avinat.com.

5. HMRC

• Avinat acts for a client with HMRC only where the client has authorised Avinat through HMRC’s own authorisation process.
• The Desk never asks for, receives or stores a client’s HMRC sign-in details. Avinat staff sign in to HMRC with their own credentials, and HMRC’s authorisation controls what Avinat can do for each client.
• Returns are filed only after the client or an authorised person has approved the figures.
• Avinat sends HMRC the fraud prevention information HMRC requires with each request.

6. Availability

Avinat aims to keep the Desk available but does not guarantee it will be uninterrupted. If it is unavailable, Avinat will use other routes to meet clients’ filing deadlines where it can.

7. Security and reporting problems

To report a security problem, email info@avinat.com. Avinat will deal with a personal data breach in line with its breach procedure, including telling the ICO and HMRC within 72 hours where required.

8. Liability

Nothing in these terms limits any liability that cannot be limited by law. Otherwise Avinat’s responsibility for work done using the Desk is set out in its engagement terms with each client.

9. Changes and law

Avinat may update these terms; the date at the top shows the latest version. These terms are governed by the law of England and Wales.
